Stanovenie relevantných trhov v digitálnom priestore

This paper addresses the issue of defining the relevant market within the context of European Union (EU) competition law. The theoretical section explores the historical development of the concept of the relevant market, the differences between economic and legal market definitions, and the legislative framework in the EU and Slovakia. The analytical section presents qualitative and quantitative approaches to defining the relevant market, including the practical application of methods such as the SSNIP and SSNDQ tests, paying particular attention to their applicability in digital markets. The article emphasises the importance of combining qualitative and quantitative procedures and highlights the necessity of a contextual approach when selecting a methodology for identifying relevant markets, given their unique characteristics within the digital ecosystem. The discussion is based on the decision-making practices of the European Commission and the judiciary and considers the relevant literature on competition law.
